APPEAL COURT HAS RULED ON WASTE OIL - 18 October 2007
The Appeal court has published its ruling on waste oil. In brief the ruling was "A lubricating oil, thus not originally used as a fuel, which becomes waste can thereafter be burnt other than as a waste". This has opened the way for such oils to be used as fuels without having to comply with the Waste Incineration Directive. The Court did not, in fact, address the details of any recovery/recycling process. In response, the Environment Agency has set up a consultative committee to draw up guidance of when used oils do cease to be waste.
